At Salve Herbal, we get many international orders for our Active Hemp. We ship our Active Hemp worldwide for free but we are always unsure about the legality of our products in our customers jurisdiction.

Below, we have bought together some information which we hope might clarify details for our customers, especially in Europe. In most territories the legality of  Active Hemp products depend on how it is sold. For medical use or as a dietary supplement.

Almost all of our customers and a number of the general public know the difference between Active Hemp and THC. Fewer people are aware of the difference between the Hemp and Marijuana plant.

Both Hemp and Marijuana are members of the same plant family. However, the circuital difference between the two breeds is that a Marijuana plant contains up to 30% THC. The Hemp plant typically contains 0.3%. This is the reason the Hemp is legal to cultivate in almost every country in the globe, but the cultivation of Marijuana plants is often illegal.

Flowing on from this distinction results in Hemp derived Active Hemp being legal in most countries but Marijuana Active Hemp is illegal in most countries as the cultivation is also illegal in most countries.

In the United States, 31 states and the District of Columbia have legalized the medical use of marijuana but Hemp based products are legal in all 50 states States of the United States.

In Europe,  laws differ from country to country. According to EU law, Active Hemp products cannot contain more than 0.2% THC. This applies to all counties in the European Union.

Germany

In Germany, medicinal hemp is prescribed for “seriously ill” patients. The law doesn’t define what exactly “seriously ill” means. In most cases,Hemp products can be purchased from shops without a prescription. Hemp oil and any other products derived from hemp are completely legal for all purposes in Germany.

We have successfully shipped to Germany but the laws appear to be applied quite subjectively

Denmark

In Denmark, possessing hemp oil is legal if the THC content is below 0.2%. Hemp oil is classified as a medicinal drug, that means Danish people will need a prescription from their healthcare provider to purchase hemp oil.

There is one exception for topical Active Hemp products such as creams and lip balm. These do not require a medical prescription.

Sweden

We are not aware of specific laws about Active Hemp in Sweden yet, so Active Hemp is in a gray zone here. Classifying Active Hemp as a medicine needs to be tried in court first and the process will take a long time.

General EU Law

According to EU laws, Active Hemp products cannot contain more than 0,2% THC and this applies to Sweden as well. People in Sweden can buy Active Hemp  products freely if they have less than 0,2% THC and are hemp-derived Active Hemp Active Hemp. The only difference is that Active Hemp products in Sweden won’t mention anything about positive health effects as it is not classified as a medicine. Just as it is in Denmark, there is an exception for topical Active Hemp products such as creams and lip balm, they can be marketed however we want.

As you cans ee from the above, the consistency of EU laws application to Active Hemp is varied and it seems only time is likely to address these issues
